AGREEMENT
Welcome to the Asisboats.com web site provided by
Asis® (“Asis”). This Purchase Agreement contains
the purchase agreement applicable to your purchase of products through
this site (“Purchase Agreement”). This Purchase Agreement
shall be effective for and applicable to any and all purchases made
through this web site.
By using this site and purchasing products through this site, you,
the user, indicate and agree that you understand and intend this
Purchase Agreement to be the legal equivalent of a signed, written
contract that is equally binding, and that you agree to such Purchase
Agreement. If you do not agree with the Purchase Agreement, you
are instructed not to use this site and not to purchase products
through this site.
Asis reserves the right to change or supplement this Purchase Agreement
at any time without notice. Your purchase of products on this site
will constitute your acceptance of such changes. Additionally, the
information and/or products on this site may be changed, updated
or discontinued at any time without notice.
Except as otherwise specifically and expressly set forth on this
web site, Asis will not be responsible or liable for any (i) delays
in shipping, (ii) inaccuracies in orders, (iii) inaccuracies in
the information on this site, (iv) unavailability of products, (v)
changes in products and/or (vi) damage occurring in delivery. Without
limiting the generality of the foregoing, please note that you should
not rely on any dimension, specification or installation information
provided on this site, as such information may be inaccurate, incomplete,
outdated and/or not applicable to your particular situation. Asis
shall have no responsibility or liability for such information,
and you assume the sole risk of any use and/or reliance thereon.
The user’s sole and exclusive remedy for any act or omission
of Asis or other condition or occurrence related to any order placed
through this site (including, without limitation, the condition,
performance, defective nature or unavailability of products ordered
through this site) shall be only as expressly provided on this site.
In no event shall Asis’s liability for any claim of any kind
related to any product ordered through this site exceed the purchase
price of such product.
Additionally, in no event shall Asis be liable for any indirect,
punitive, incidental, special or consequential damages arising out
of, or in any way connected with, the purchase of (or inability
to purchase) any products through this site, whether based in contract,
tort, strict liability or otherwise, and even if Asis has been advised
of the possibility of any such damages. Due to the fact that some
states and/or jurisdictions do not allow the exclusion or limitation
of liability for consequential or incidental damages, some or all
of the above limitation may not apply.
This Purchase Agreement will be governed by the laws of Dubai,
United Arab Emirates without giving effect to the choice of law
provisions thereof, and all parties to this Agreement expressly
agree to be subject to the jurisdiction of courts in the City of
Dubai, United Arab Emirates.

ASIS WARRANTY
APPLICATION & TERMS
1. This warranty is applicable to the original
purchaser of an Asis Boat used for leisure purpose only. This warranty
is not transferable.
2. Asis warrants the buoyancy tubes, seams and
transom attachment of its inflatable and rigid hull boats to be
free from defects in materials and workmanship for a period of two
years from date of original purchase or Asis will repair or replace
said inflatable structure (at its sole discretion) at no charge
for labor and materials. ( excluding shipping costs). Asis retains
the right to substitute comparable product.
- Purchasers of Asis inflatable boats who return their owner
registration card and questionnaire or register online will be
eligible for an additional warranty extension of three years.
This extension will warrant that the fabric of the buoyancy tubes
will be free of defects in material and workmanship, and that
the buoyancy tube seams will maintain air holding integrity equal
to the International Standard Organization's (ISO), Standard No.
6185.
- Upon receipt of the owner registration card and questionnaire,
by Asis, a three year warranty extension certificate will be issued
to the purchaser.
3. Asis warrants the fiberglass hull of the rigid
hull inflatable boats to be free from defects in materials and workmanship
for a period of one year.
4. Asis parts, attachments and accessories are
warranted to be free of defects in material and Structure for a
period of one year from original date of purchase.
5. This warranty will be void if the Hull Identification
Number (HIN) plate attached to the transom is changed, defaced or
detached in any way.
6. Determination of eligibility will be made by
Asis after inspection of the condition of the boat by an authorized
service center.
EXCLUSION FROM THIS WARRANTY
Misuse, abuse or negligence, such as improper docking or towing,
and over/under inflation.
The use of outboard power in excess of that specified on the HIN
plate
Competition, charter, rental, commercial or other usage for which
the product is not intended.
Collision, improper towing, puncture, tearing, ripping, abrasion,
theft, fire, etc.
Alteration or tampering, such as transom modification for installation
of an engine with incorrect shaft length.
Damage or surface corrosion from abnormal environmental conditions,
including but not limited to airborne fallout, tree sap, chemical
spills, acid rain, hail, wind storms, lightning, etc.
Damage, such as corrosion of metallic parts, due to lack of maintenance,
or premature wear resulting from improper assembly or over/under
inflation.
Normal deterioration, wear, discoloration, deformation, dulling,
crazing and aging of fabrics, metals, woods, plastics or fiberglass.
Cost of normal maintenance and cleaning.
Costs resulting from loss of use, including but not limited to
transportation, freight, rigging/de-rigging.
Consequential damages.
Water damage to wooden parts, wooden laminates or composite assemblies
resulting from failure to maintain the protective coating of these
parts (varnish, paint, caulking, etc.)
PROCEDURES:
To receive service under this warranty, you must take your boat
or defective part, with proof of purchase (bill of sale and/or warranty
card), to an authorized dealer or authorized service center for
inspection during normal working hours. For the location of your
nearest authorized service center, please see our webpage. Please
contact your dealer first for service, within 30 days of occurrence
of defect.
OTHER IMPORTANT INFORMATION:
1. This warranty is exclusive and in lieu of all other
express warranties. Implied warranties, including but not limited
to the implied warranties of merchantability and fitness for a particular
purpose, shall not extend beyond the duration of the express warranties
provided herein. Asis's sole obligation and your exclusive remedy
under this warranty is limited to repair in accordance with this
warranty. Asis shall not be liable for any consequential, incidental,
or contingent damages whatsoever.
2. Asis reserves the right to make changes in
the design and material of its inflatable boats without incurring
any obligation to incorporate such changes in units already completed
or in the hands of dealers or consumers. The entire obligation of
Asis regarding the sale of its inflatable boats is stated within
this written warranty, except as otherwise provided by law.
3. Asis does not authorize its dealers or any
other person to assume for it any other liability in connection
with the sale of its inflatable boats.
4. The Federal Boat Safety Act of 1971 provides
for defect notification by the manufacturer to first purchasers.
Failure to register your purchase with the manufacturer by filling
out the owner registration form constitutes waiver of the right
to defect notification. This warranty is effective to all boats
sold at customer level from January 1, 1994 and supersedes all previous
warranties.
